PREAMBLE

 

These Terms and Conditions (hereinafter "T&C") govern the use of the website www.aguadalma.pt and the provision of hotel services by Mondim Domingues, Lda (hereinafter "Água d'Alma Hotel" or "Hotel"), a 3-star hotel establishment located in Foz do Arelho, Portugal.

 

The entity responsible for the provision and management of services is Mondim Domingues, Lda, hereinafter referred to as "Hotel" or "Água d'Alma Hotel".

2. ACCEPTANCE OF TERMS AND CONDITIONS

 

By making a reservation or contracting accommodation services at Água d'Alma Hotel, the Guest declares that they have read, understood and fully accept these Terms and Conditions, as well as the Privacy Policy available at www.aguadalma.pt/en/privacy-policy.

 

The Hotel reserves the right to modify, alter or update these T&C to reflect legal, regulatory or operational changes, with such changes being published on the website and taking immediate effect. Changes will not affect bookings already confirmed.

 

3. SCOPE AND PURPOSE

 

These T&C govern the provision of the following services:

• Accommodation bookings

• Food and beverage services (breakfast and bar)

• Complementary services (massages, experiences, promotional packages)

• Purchase of vouchers and other products

• Use of hotel facilities

 

4. BOOKINGS

 

4.1. Availability and Confirmation

Bookings are subject to hotel availability at the time of confirmation. After making a booking, the guest will receive a confirmation email with booking number, check-in and check-out dates, room type, applicable conditions and total amount payable.

 

4.2. Dynamic Rates

The rates shown in the booking engine are dynamic and may vary according to availability, demand, selected dates, number of guests or other market conditions. The final price will always be confirmed at the time of booking.

 

4.3. Booking Amendments

Amendments to bookings (dates, room type, number of guests) are subject to availability and may incur additional costs. All amendments must be requested by email to [email protected] with a minimum of 72 hours' notice.

 

4.4. Group Bookings

Bookings for more than 3 rooms are considered group bookings and may be subject to different conditions. Contact [email protected] for specific terms.

 

5. PRICES AND PAYMENT METHODS

 

5.1. Prices and Taxes

All prices include VAT at the legal rate in force in Portugal.

 

5.2. Currency and Exchange

All bookings and transactions are processed and paid exclusively in euros (€). The display of amounts in other currencies in the booking engine is for indicative purposes only. We do not apply exchange rates or additional charges. If the guest's currency differs from the euro, currency conversion and any applicable fees are the sole responsibility of the guest and their banking institution.

 

5.3. Payment Methods

Água d'Alma Hotel accepts the following payment methods:

  • Credit and debit cards (Visa, Mastercard)
  • Bank transfer
  • Cash payment (at the hotel, within legal limits)
  • Multibanco, MBway, Reference Entity
  • PIX
  • IDEAL

 

5.4. Payment Terms

Depending on the contracted rate:

Flexible rates: Guaranteed with valid credit card. Payment of the first night's value at the time of booking. Remaining payment at check-in.

Non-refundable rates: Advance payment of 100% of the total amount at the time of booking.

Special offers: Specific conditions indicated in the offer.

 

5.5. Payment Security

All online payments are processed through secure systems with SSL/TLS encryption and HTTPS protocol, ensuring maximum security and confidentiality of financial data.

The HeyTravel booking engine integrated into the website is maintained and managed by HHS – Host Hotel Systems, Lda (Tax ID 503235903, with registered office at Rua Paiva de Andrade, no. 4, 1st floor, 2560-357 Torres Vedras). Card data is kept only for the period necessary to ensure settlement of charges, and is subsequently securely deleted in accordance with GDPR.

 

6. BOOKING TYPES AND CANCELLATION

 

6.1. Flexible Rates

Guarantee: Bookings with flexible rates are guaranteed by providing a valid credit card at the time of booking.

 

Cancellation Policy:

• Cancellation up to 72 hours before arrival: No charges

• Cancellation between 72 hours and arrival date: The value of the first night will be charged

• No-show: The total booking value will be charged

The Hotel reserves the right to debit the card provided with the amount corresponding to the applicable penalty.

 

6.2. Non-Refundable Rates

Bookings made with non-refundable rates require full payment of 100% of the stay value at the time of booking, with this amount being non-refundable.

Cancellation Policy: Bookings with non-refundable rates do not allow cancellations and, in case of no-show, no refund will be made.

 

6.3. Travel Insurance Recommendation

The Hotel does not make exceptions to its cancellation policy regardless of any medical situations, personal reasons, adverse weather conditions or other unforeseen circumstances. We strongly recommend taking out appropriate travel insurance before confirming your booking.

 

6.4. Cancellation by the Hotel

Água d'Alma Hotel reserves the right to cancel bookings in situations of force majeure, involuntary overbooking or other exceptional circumstances, proceeding with full refund of amounts paid without incurring any other liability.

 

7. CHECK-IN AND CHECK-OUT

 

7.1. Times

Check-in: From 15:00

Check-out: Until 12:00

 

7.2. Required Documents and Credit Card

At check-in, the following must be presented:

• A valid photo identification document (Identity Card, Passport or legally recognised document)

• A valid credit card, even for prepaid bookings, to guarantee any additional and incidental expenses

Payment of the full stay (if not already made) must be completed at check-in.

 

7.3. Credit Card Pre-authorisation

The Hotel reserves the right to make a pre-authorisation on the credit card to cover any charges during the stay. This amount is not immediately debited, being only held on the card.

Pre-authorisation amount: €250 (may vary depending on length of stay)

After check-out and confirmation of no outstanding charges, the pre-authorisation will be released. The availability of funds depends on the issuing bank and is beyond the Hotel's responsibility.

 

7.4. Cash Deposit

In the absence of a credit card, a cash deposit of €150 may be required. This deposit will be fully refunded at check-out, minus any unpaid expenses or verified damage to the room/equipment attributable to the guest.

Use of a credit card whose holder does not correspond to the booking holder may be refused, except with formal authorisation from the cardholder.

 

7.5. Early Check-in / Late Check-out

Subject to availability and upon payment of supplement. Prior confirmation with the hotel is recommended.

 

7.6. Luggage Storage

Guests who arrive before check-in time or depart after check-out may request complimentary luggage storage.

 

8. USE OF FACILITIES AND ROOMS

 

8.1. Room Capacity

Each room has a defined maximum capacity. It is not permitted to exceed the number of occupants without prior authorisation and payment of supplement.

 

8.2. Children and Extra Beds

• Children up to 3 years: Free (using existing bed)

• Cot: €9 per night (children up to 3 years)

• Extra bed: €39 per night (children > 3 years and adults)

• Maximum capacity: 1 extra bed or cot per room

Extra beds and cots must be requested in advance and are subject to confirmation.

 

8.3. Pets

Pets are not allowed on the hotel premises.

 

8.4. No Smoking Policy

Smoking is prohibited in all indoor areas of the hotel, including rooms, corridors, bar and common areas, in accordance with Portuguese legislation. Guests who do not respect this rule are subject to an extraordinary cleaning fee of €250.

 

8.5. Liability for Damage

The guest is responsible for any damage caused to the room, furniture, equipment or hotel facilities during their stay. The hotel reserves the right to charge repair or replacement costs, which will be debited from the credit card provided or deducted from the deposit.

 

8.6. Lost Property and Valuables

The hotel is not responsible for valuables left in rooms or common areas. It is recommended to store valuables at reception.

 

9. INCLUDED AND OPTIONAL SERVICES

 

9.1. Breakfast

• Included in accommodation rates

• Times: 07:30 to 10:30

• Format: Breakfast buffet

 

9.2. Wi-Fi Internet

Free Wi-Fi internet access throughout the hotel.

 

9.3. Parking

Free parking available on site (subject to availability).

 

9.4. Optional Services

Subject to availability and additional payment:

• Massages and wellness treatments

• Experiences (boat trips, nautical activities, tours)

• Special packages and vouchers

• Other services upon request

 

10. SPECIAL REQUESTS

 

The Hotel will make every effort to accommodate special requests made by guests, such as preferences regarding room location, specific diets, early check-in or late check-out, among others.

These requests are subject to availability upon arrival and may incur additional costs. Prior confirmation from the hotel is recommended.

 

11. BEHAVIOUR AND CONDUCT RULES

 

Guests must:

• Respect the peace of other guests, especially during night time (22:00 - 08:00)

• Observe the hotel's conduct and safety rules

• Use the facilities appropriately and carefully

• Respect the instructions of hotel staff

The hotel reserves the right to refuse or terminate accommodation of guests whose behaviour is considered inappropriate, offensive or disruptive, without right to refund.

 

12. PERSONAL DATA PROTECTION

 

12.1. Commitment to Privacy

Água d'Alma Hotel recognises the importance of protecting the privacy and personal data of its guests. Any personal information collected through the website or during the booking/check-in process will be processed in accordance with the General Data Protection Regulation (GDPR - Regulation EU 2016/679).

 

12.2. Data Collected and Purpose

In the context of bookings and stays, the following data may be collected:

• Full name and contact details (telephone, email, address)

• Identification document details (required at check-in)

• Credit card information (for booking guarantee/payment)

• Preferences or special requests

This data is used exclusively to:

• Manage the booking and stay, ensuring provision of contracted services

• Comply with legal and tax obligations (invoice issuance, data retention for the legally defined period)

• Ensure transaction security (card data processed securely)

• Marketing purposes: only if the guest has given express consent

13. FORCE MAJEURE

 

The Hotel cannot be held responsible for any failure to perform, or delay in performance, of its obligations if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to:

• Acts of God or natural disasters (fire, flood, earthquake)

• War, terrorism, civil unrest

• Governmental act or legislative changes

• Labour disputes, strikes

• Pandemics or epidemics

• Failures of external systems or supply of essential services

• Other unforeseeable events that could not have been avoided with reasonable diligence

In the event of force majeure, the Hotel will contact the guest as soon as possible, explaining the situation and expected impact, and will attempt to mitigate the impact on the booking or stay. The Hotel may cancel the booking and offer an alternative date or refund, without incurring any other liability.

15. APPLICABLE LAW AND JURISDICTION

 

15.1. Applicable Law

These Terms and Conditions are governed by Portuguese law.

 

15.2. Jurisdiction

For the resolution of any dispute arising from these T&C or the provision of services, the courts of the district of Caldas da Rainha shall have jurisdiction, with express waiver of any other.

 

16. FINAL PROVISIONS

 

16.1. Amendments to T&C

Água d'Alma Hotel reserves the right to amend these T&C at any time. Changes will come into effect after publication on the website, and will not affect bookings already confirmed.

 

16.2. Partial Invalidity

The nullity or ineffectiveness of any clause of these T&C shall not affect the validity of the remaining provisions.

 

16.3. Communications

All communications between the hotel and guests must be made in writing (email or letter) to the contacts indicated in section 1 of these T&C.

 

16.4. Languages

These T&C are available in Portuguese and English. In case of discrepancy, the Portuguese version shall prevail.
